Halting work on an agricultural room in An-Nabi Elyas village/ Qalqilya governorate

Description:

Monday , 15 July 2019 , The Israeli occupation forces accompanied by a vehicle from the building and organization committee raided An-Nabi Elyas village east Qalqilya , and the occupation forces gave farmer Nael Khalif from the village a halt of work order numbered (00455)   on his agricultural room (16 m2) built of zinc and bricks and used   as storage for agricultural tools and a resting room.

Affected citizen told LRC reporter:

“The targeted room is in the north east of An-Nabi Elyas village about 250 m from bypass 5 that  divides the village , they were built to provide a storage place and a place to rest in during working in the 9 dunums plot”

Noteworthy, the occupation sets 29 July 2019 , as the building and organization session to decide the fate of the structures.

Reportedly, the occupation demolished four agricultural rooms and barracks in An-Nabi Elyas village which reflects the occupations attempt to tighten the siege around people of the village.

About Nabi Elyas:

It is located 6km to the east of Qalqiliya governorate and is edged by Izbbet Al-Tabib and Aslah villages from the east, Arab Abu Fardeh area from the west, Jayyous town from the north and Ras Tayreh from the south.

The village populates 1399 inhabitants (2017 census) that are relative to three main families namely ( Hannun, Khleif and Majd)

Nabi Elyas has a total area of 4435 dunums, of which 123 dunums are considered the village’s built-up area. Noteworthy, more than 2200 dunums of the area were isolated behind the apartheid wall and became subject to colonial activities of takeover and expansion.

International Conventions and agreements pertaining to house and residents demolition:

  • Article 147 of Geneva fourth convention : extensive destruction and appropriation of property, not justified by military necessity and carried out unlawfully and wantonly. ( it is considered a serious violation of the convention)
  • Article 53 of Geneva fourth conventionthat forbids destroying properties : Any destruction by the Occupying Power of real or personal property belonging individually or collectively to private persons, or to the State, or to other public authorities, or to social or co-operative organizations, is prohibited, except where such destruction is rendered absolutely necessary by military operations.
  • Article 33 of Geneva fourth convention:No protected person may be punished for an offence he or she has not personally committed.
  • Article 32 of Hague convention 1907 part g: To destroy or seize the enemy’s property, unless such destruction or seizure be imperatively demanded by the necessities of war.
  • Article 17 of Universal declaration of human rights 10 –Dec- 1948:No one shall be arbitrarily deprived of his property.
