  • Violation : Uprooting trees and destroying cisterns.
  • Location : Umm Kbaish – South Tamoun village / Tubas governorate.
  • Date: 11/06/2019.
  • Perpetrator: Nature Authority –  The Israeli occupation Civil Administration.
  • Victims: 3 Palestinian families from Tamoun village.

Description:

In the early morning hours of Tuesday, 11th June 2019, The Israeli occupation forces accompanied by a bulldozer raided “Umm Kbaish” south east Tamoun in Tubas governorate.

Te occupation left the following damages:

  • Uprooting 280 olive trees , aging eight years old.
  • Destroying a water cisterns with a capacity of 60 m3.
  • Destroying three water reservoirs with a capacity of 1 m3.
  • Sabotaging 150 m of irrigation pipes from the land of Jihad Bani Oudeh , which is located in natural block 26 plot number 1.

Farmer Jihad Bani Oudeh told LRC reporter:

“My brothers (Mohannad Bani Oudeh and Abdullah Bani Oudeh) and I , own a piece of land in “Umm Kbaish”  6 km south Tamoun village , which is a high area overlooks the Jordan Valley and Jordanian mountains . Noteworthy , the area of the plot is 24 dunums , and we own legal documents for the plot. In 2012 we received aid from the Arab Group for the Protection of Environment who provided us with 250 olive saplings, that we planted on half the area of the  plot . The FAO also helped me through digging a 60 m3 water cistern .

In February, I received a military order that requests the eviction of the plot under claims that it is a natural reserve , at once we hired lawyer Tawfiq Jabareen to follow up the casa, and after several sessions we managed to freeze the eviction order for a while. Then, we filed an application to register the land in the occupation’s records, and they accepted as a start. But in the morning of Tuesday, the civil administration raided the plot , uprooted the trees and destroyed the cistern, I called the lawyer who called the prosecutor’s office , the last said that the civil administration made the decision on its own, and was not supposed to carry out the demolition.”

In the same context, The occupation authorities uprooted 150 forest trees and destroyed a cistern with a capacity of 60 m3 (implemented by MoA in 2012 with the funding of Arab Group for the Protection of Environment) on a 6 dunums plot, the plot received an eviction order under claims that it is an Israeli state’s property.

Mutaz Bsharat who accompanied LRC reporter to the targeted plot , said the “Umm Kbasih” area has a beautiful nature and a strategic location, and provides an income source for several farmers, and apparently,  there is an Israeli scheme to take over the area for colonial expansion.

Land Research Center sees that grabbing and confiscating Palestinian lands is a flagrant violation of all international conventions and agreements that are related to natural resources:

Article 1 of the International convent on Civil and Political rights: part 2. All peoples may, for their own ends, freely dispose of their natural wealth and resources without prejudice to any obligations arising out of international economic co-operation, based upon the principle of mutual benefit, and international law. In no case may a people be deprived of its own means of subsistence.

Article 17, of the Universal Declaration of Human Rights.

  • (1) Everyone has the right to own property alone as well as in association with others.
  • (2) No one shall be arbitrarily deprived of his property.
