Demolition and confiscation of facilities in Um Neer and Al-Mufqara south Yatta / Hebron governorate

Description: The Israeli occupation forces demolished a residential tent owned by Fareed Jbour in Um Neer hamlet, and confiscated an agricultural barracks belong to farmer Qasim Hamamdeh in Al-Mufqara Hamlet south Yetta.

Demolition and confiscation of a tent in Um Neer hamlet:

Members of the Israeli occupation army broke into Um Neer hamlet and besieged the tent of villager Fareed Al-Jbour, then dismantled and confiscated it, they also handed a notice to Al-Jbour entitled with “confiscation of property” the notice said that the confiscated property will be kept in “Kfar Etzion” settlement.

Al-Jbour planted the tent to stay in it during agricultural seasons, He owns a land and depends on animal husbandry for living , The tent has an area of 20m2 , and was occupied by Al-Jbour family(consists of 5 members, 3 of them are children.)

Demolition and confiscation of an agricultural barracks:

Members of the Israeli occupation army broke into Al-Mufqara hamlet and besieged an agricultural barracks owned by Villager Qasim Hamamdeh , dismantled the barracks and confiscate all of its parts, they also handed a notice to Hamamdeh intitled with “confiscation of property” the notice said that the confiscated property will be kept in “Kfar Etzion” settlement.

Farmer Hamamdeh planted the barracks to keep his 5 cows that are his source of income. The barracks had an area of 100m2, and was built 2 months ago, the occupation authorities had confiscate it without delivering preceding notices.

Demolition of facilities in international law:

 The Universal Declaration of Human Rights:

Article 17: ” (1) Everyone has the right to own property alone as well as in association with others.

(2) No one shall be arbitrarily deprived of his property.”

The 1907 the Hague Convention

 Article 23: ” In addition to the prohibitions provided by special Conventions, it is especially forbidden to destroy or seize the enemy’s property, unless such destruction or seizure be imperatively demanded by the necessities of war.”

The Geneva Fourth convention

Article 53: ”  Any destruction by the Occupying Power of real or personal property belonging individually or collectively to private persons, or to the State, or to other public authorities, or to social or cooperative organizations, is prohibited, except where such destruction is rendered absolutely necessary by military operations.”

The International Covenant on Economic, Social and Cultural Rights:

Article 11.1 states: “The States Parties to the present Covenant recognize the right of everyone to an adequate standard of living for himself and his family, including adequate food, clothing and housing, and to the continuous improvement of living conditions. The States Parties will take appropriate steps to ensure the realization of this right, recognizing to this effect the essential importance of international co-operation based on free consent”.
