  • Violation: demolition of nine structures
  • Location:  Qalqiliya governorate
  • Date: November 10, 2016
  • Perpetrators: Israeli Occupation Forces
  • Victims:  citizens Salim Nazzal and Abdelhalim Abu Oubah

Details:

Israeli Occupation Forces demolished on November 10, 2016 two agricultural rooms in Qalqiliya governorate on the claim of "proximity to the apartheid wall".

In the western part of Qalqiliya, more specifically in the area known as Al-Naqqar neighborhood, Israeli Occupation Forces demolished a 9m2 agricultural room built by metal slaps and a mobile toilet. The structures were reported to be owned by citizen Salim Nazzal. The affected citizen used the first room to store seeds and agricultural equipments that he uses in his 20 dunum plot planted with field crops and vegetables.

It should be marked that Nazzal was served a stop-work order in 2016. At time, more than 40 residences were notified of stop-work in the same area. The occupation refused all licensing procedures on the claim of "proximity to the apartheid wall".

Demolition of seven agricultural structures in Al-Razzaza neighborhood:

To the east of Qalqiliya, Israeli Occupation Forces raided Al-Razzaza neighborhood and demolished seven structures and a 40 meter retaining wall. The demolished structures are:

  1. Metal slaps room(9m2) used for storing fodder
  2. Metal slaps toilet (mobile)
  3. Wood kitchen (9m2)
  4. A green house
  5. Water tank 16m3
  6. Chicken barn (12m2)
  7. Electricity providing cable

Not only, four almond trees were uprooted during the attack.

The demolished structures belong to citizen Abdelhalim Abu Oubah from the city.

The son of Abdelhalim told Land Research Center the following:

" Two years ago, the occupation demolished a farm of ours on the claim of "proximity to the apartheid wall". One year ago, we were served a stop-work order and later in November we received another demolition order. At time, we immediately embarked on preparing all needed documents and files to obtain a license. But the occupation demolished the farm even before we get the permit.  Noteworthy, the occupation never grants such permits for Palestinians on claims of "security purposes".

Land Research Center LRC sees that demolitions contradict with all of the International conventions and Humanitarian laws including:

  1. Article 17 of the (1948) Universal Declaration of Human Rights stating: “Everyone has the right to own property alone as well as in association with others. No one shall be arbitrarily deprived of his property.”

  1. Section ‹G› of article 23 of the (1907) The Hague Conventions asserting: “In addition to the prohibitions provided by special Conventions, it is especially forbidden to destroy or seize the enemy's property, unless such destruction or seizure be imperatively demanded by the necessities of war.”
  2. Article 53 of the Geneva Fourth Convention (1948) declaring: “Any destruction by the Occupying Power of real or personal property belonging individually or collectively to private persons, or to the State, or to other public authorities, or to social or cooperative organizations, is prohibited, except where such destruction is rendered absolutely necessary by military operations.”
